My diere children, my brother and sister, with a trembling hart and hand, I take my pen in hand to informe you of oure health and allso of oure distress as to health. We are as well as we cold expect to be from the fatigue and trouble that we have suffered in the afliction and death of oure diere frend, my wife. She died the eigth day of November at the sheting in of day light. She thinks that she taken cold from washing ?????? and a Satterday, she begin to feele unwell but kep up, and on Sundy she worse, and on Mundy she kep here bed and complained of being cold. A Tueseday she complained of nothing but hart sick. On Wensday she look a strong aguer. A Thursday I went to her and asked her how she felt and she reached up her arm and took me round the neck and puled me down to her. She told me she was gone tho her augers. Continued two days of this tho she apierd rite smart the days that she had augeur, more so then she did the days that she had none. The days that she had no auger, she talked none at all. Only when she was asked some questions, she wood answer as good as ??????? in her senses and continued so untill the children come. Tha come aboute one a clock in the evening. The same evening the (summoning?) she died. It apierd as tho she new them. She spoke hoo or there words to Sady. Sady was talking about the death of Mr. Calhoons children and she asked who, but it was hard to understand her. Then Sady gave me two apples that Richerson Blar had sent to me, and her and I showed her them and she moved her hand and turned her legs, but never spoke and continued to untill about the sheting in of day light and died, as it apiere cosy and sattisfied in mind. I believe that I have told you as much as I am able at the present concerning her death. I must inform you that I am in a lonesome situation, such I am not able to discribe. I will shough say something to Washington. I wood be glad that it cold be agreeable to you and Betsy to move down here and live uppon my land as it wood aford me grate attisfaction to have youre company as I am left alone. Not as I want to persuade you against your own mind. I want you to enjoy your own mind about wheare you can do the best, but if this cold be the place, of corse I shold be glad, and if you come down, you can live in the house with us untill you can build, if you want to bild. So no more, but remains youre living father until death, so farewell.

WILL OF JOHN HEATH

DeKalb Co., Tenn.

 

 

 

I John Heath of the County DeKalb and State Tennessee Planter do make and publish my last will and testament hereby revoking and making void all former wills by me at any time heretofore made, I direct that my Body be decently Entered at the Grave Yard in said John Heaths pasture and in said County in a manner suitable to my condition in life and to such worldly estate as it hath please God to Entrust me with I dispose of the same as follows. First I direct that all my Debt and funeral expenses be as soon paid after my Decease as possible out of any moneys that I may die possessed of or may first come into the hands of my Executors from any portion of my Estate, real or Personal. Secondly, I give and bequeath unto my beloved wife Marget Heath all my House hold and kitchen furniture and all of stock of horses, hogs and cattle and sheep. Also one negro boy named Henderson and all of my money and cash notes also I give and unto my beloved daughter Nancy James and her bodily Heirs a certain tract of Land on the South of Caney Fork river where on I now live which is to say the upper part of the bottom down to conditional line-

Marked by Z. Kirkland sec I give and bequeath unto my beloved daughter Martha James the part my tract of lands from S.S. Conditional line containing by supposition eighty three acres to said Martha James and her bodily heirs. I also Give and bequeath unto my beloved son Willian Heath One dollar in Cash. I also Give and b bequeath unto my beloved son Richard Heath one Dollar in Cash. I also give and bequeath unto my beloved son Simon P. Heath one dollar in Cash. I also Give the rest of my Estate after the Decease of My Beloved wife to my beloved daughters Nancy James and Martha James what there is found and Equal portion to both. I do here by make ordain and appoint Hampton James and Thomas James Executors of this my last will and testament in witness where of I John Heath the said testator set hand and seal this 20th of August in the year of our Lord Eighteen Hundred and forty two.

On motion a paper purporting to be the last will and testament of John Heath dec'd who died in DeKalb County Tennessee was presented in open court for probate and was duly proven in open court by the oath of Zachariah Kirkland and Nicholas Parsley subscribing witness to the same who being first duly sworn in open court depose and say they were acquainted with John Heath the within testator and that they signed the said will by his request in his presence at his dwelling house in said County and in motion ordered that said will be admitted to records.
